Terms of Service

1. Agreement to Terms

By accessing or using CarbonTiers ("the Service"), operated by Ali Erdinc Ersoy, trading as CarbonTiers ("we," "us," or "our") at carbontiers.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

2. Description of Service

CarbonTiers is a Software-as-a-Service (SaaS) platform providing greenhouse gas (GHG) emission calculation tools based on IPCC 2006 Guidelines and GHG Protocol methodologies. The Service includes sectoral calculation modules for Energy, Industrial Processes, Agriculture, Waste, and Land Use, Land-Use Change and Forestry (LULUCF).

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and accept responsibility for all activity under your account.
• Notify us immediately at info@carbontiers.com of any unauthorised use of your account.
• Be at least 18 years of age or have parental/guardian consent.

4. Subscription Plans and Payment

CarbonTiers offers Free, Pro Single Sector, and Pro National Inventory subscription plans. Paid plans are billed through Paddle (paddle.com), our authorised Merchant of Record.

• Subscription fees are charged at the beginning of each billing period (monthly or annual).
• All prices are listed exclusive of applicable taxes; taxes are calculated and displayed at checkout.
• Paddle handles all payment processing, invoicing, and tax remittance on our behalf.
• You authorise Paddle to charge your payment method on a recurring basis until you cancel.
• Failure to pay may result in suspension or termination of your paid access.

5. Cancellation

You may cancel your subscription at any time from your account settings or by contacting us at info@carbontiers.com. Cancellation takes effect at the end of the current billing period; you retain access until that date. We do not pro-rate partial billing periods unless required by applicable law.

6. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the Service.
• Use the Service for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reproduce, resell, or redistribute the Service or its output without our prior written consent.
• Upload malicious code, scripts, or content that could harm the Service or other users.

7. Intellectual Property

All content, algorithms, calculation methodologies, software, designs, and trademarks on the Service are the exclusive property of CarbonTiers or its licensors. Nothing in these Terms grants you any right to use our intellectual property outside of the permitted use of the Service.

You retain ownership of any data you input into the Service. By submitting data, you grant us a limited, non-exclusive licence to process that data solely to provide the Service to you.

8. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Calculation results are provided for informational purposes only. They do not constitute professional advice and should not be relied upon as the sole basis for regulatory compliance decisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CarbonTiers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable international commercial law. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to binding arbitration or the jurisdiction of the competent courts as mutually agreed.
